Welcome to Magnolia Home. This website and the services provided herein are operated by Magnolia Home. Throughout the site, the terms “we”, “us” and “our” refer to Magnolia Home. By visiting our site, purchasing ready-made inventory, or commissioning bespoke furniture from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

Please read these Terms carefully before accessing our website or placing an order.

1.    General Conditions & Eligibility

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from us.

2.    Accuracy of Information, Pricing, and Modifications

While we strive for absolute precision, we are not responsible if information made available on this site is not accurate, complete, or current.

1. Pricing & Availability: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.
2. Product Displays: We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your computer monitor's or mobile device's display of any colour or texture will be perfectly accurate.

3.    Intellectual Property Rights

All content included on this website—such as text, graphics, logos, button icons, images, digital downloads, data compilations, custom furniture designs, blueprints, and proprietary material—is the exclusive property of Magnolia Home or its content suppliers and is protected by local and international copyright, trademark, and intellectual property laws.

4.    Billing, Account Accuracy, and Payment

We reserve the right to refuse or limit any order you place with us. These restrictions may include orders placed by or under the same customer account, the same credit card, or orders that use the same billing and/or shipping address. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

5.    Returns, Refunds, and Exchanges

All returns of ready-made stock items, damage claims, and refunds are strictly governed by our Refund & Return Policy, which is incorporated into these Terms by reference. Standard stock items carry a 7-day return window. Damage or defect claims must be submitted with photographic evidence to WeCare@magnoliahomepk.com within 48 hours of delivery.

6.    Bespoke & Made-to-Order Commissions

Bespoke items—including any piece manufactured or modified to customer-specified dimensions, materials, finishes, upholstery, or custom engravings—are crafted exclusively for you and cannot be resold. Consequently, all bespoke and made-to-order items are strictly non-returnable, non-exchangeable, and non-refundable under any circumstances.

The following terms apply to all custom commissions:

1. Order Confirmation & Advance: Bespoke orders are formally confirmed only upon receipt of a 50% advance payment and written approval of design specifications via email or WhatsApp. Once materials are procured or production begins, this advance payment is entirely non-refundable as it is applied directly to materials and craftsmanship committed to your piece.
2. Cancellation Window: You may cancel a bespoke order within 48 hours of your advance payment, provided production has not yet commenced.
3. Balance & Passing of Title: The remaining 50% balance must be settled in full prior to dispatch, shipping, or physical handover. Legal ownership and title of the goods remain strictly with Magnolia Home until full payment has been received and cleared.
4. Storage & Forfeiture: If the outstanding balance is not settled within 14 days of our notification that your piece is complete, or if delivery of a conforming item is refused, the advance payment will be permanently forfeited to cover material, labor, and storage overheads. Magnolia Home reserves the right to resell or otherwise dispose of the piece without further liability to the customer.
5. Production & Delivery Timelines: Production schedules and delivery dates are estimates provided in good faith. Because our products undergo stringent quality assurance checks, unexpected material delays or craftsmanship timelines may arise. Such delays do not entitle the customer to order cancellation, a refund, or financial compensation.
6. Artisanal Variance: Minor natural variations in wood grain, colour tone, texture, natural leather markings, and hand-applied finishes are expected characteristics of artisanal furniture and do not constitute manufacturing defects or grounds for rejection.

7.    Limitation of Liability & Indemnification

In no case shall Magnolia Home, our directors, officers, employees, affiliates, agents, contractors, or interns be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages—arising from your use of any of the service or any products procured using the service.

You agree to indemnify, defend and hold harmless Magnolia Home from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.

8.    Severability & Termination

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

9.    Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Pakistan, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Lahore.
